Kentucky Dog Bite Injury Lawyers

In Kentucky, for example, the owner of any dog, cat, or ferret which bites a human being   shall be liable to pay all damages for personal injuries resulting from the bite.  KRS §258.990.  For the purposes of dog bites and dog attacks, a dog is defined as any domestic canine six months of age or older. Meaning any domestic canines under six months of age are not subject to the provisions of the following statutes. KRS §258.095(4).

An "owner" is broadly defined in Kentucky and is not limited to only the individual who has purchased the dog. An owner includes every person having a right of property in the dog and every person who keeps or harbors the dog, or has it in his care, or permits it to remain on or about premises owned or occupied by him.  KRS §258.095(5). This definition has been read to include not only the tenants of a building or apartment owned by another, but a landlord or building owner may be liable under these provisions for the dogs of his or her tenants. See for example the Court's decision in Benningfield v. Zinsmeister, 367 S.W.3d 561. 

A dog attack, in Kentucky, is defined as a dog’s attempt to bite or successful bite of a human being.  However, a dog’s attack of a person who has illegally entered or is trespassing on the dog owner’s is not defined as an attack under certain conditions. KRS §258.095(6). Each case is different, and should be closely examined by a lawyer experienced handling dog bite injury cases.
